I'm so sorry this happened! *hugs*

Just a little note---do NOT claim it on your homeowners policy unless it's absolutely necessary. It's not worth it. I talked to a guy last year wanting to return his dog to the rescue because he jumped up and knocked a neighbor girl down and she bumped her lip and her family threatened to sue. They claimed it on the Homeowners policy and the claim was totalled at $1000. Then of course their company said they had to get rid of the "vicious" dog or they were going to drop them. I worked with them to find them an insurance company that would insure them with the dog and the premiums were VERY high and of course, they were unwilling to pay it. SO, they dumped the dog.

I know dumping your dog wouldn't ever cross your mind, but in your case, because the idiot was partly at fault, I would take my chances and go to court. Not to mention that once he's deemed vicious, you'll have to be very careful and you'll have to changed your whole lifestyle because if he were ever to do anything like that again, you could be considered negligent.

Again.....BIG hugs....

Why is it the animal is always at fault, no matter how egregious the stupidity and maliciousness of the "human" who gets bit/scratched/pushed down as a result of their idiocy? Yes, folks, there is always some hungry lawyer out there, waiting to take your case, no matter how stupid your acts were that got you hurt.

Same mentality as lawsuits against fast food chains blaming them for kids being overweight... people can't seem to take responsiblity for their own behaviours and the consequences!!!

Although Dora, it sounds like in your case this guy knew it was his fault... let's hope he doesn't press it any further :) .

I doubt this would go to court:

"Sir, what were you doing when the dog attacked you?"

What's he going to say? He was abusing your cat?

"Had you had anything to drink?"

Just a guess... But I wouldn't be too sympathic to this guy if I were a judge.

It's too bad you had to start off the new year that way.

Keep us posted on what happens, and tell Rocky that I commend him on saving his kitty from the bad guy:)

Bummer way to start the new year. I agree with everyone else.... Rocky was just protecting his kitty from the idiot! Argh, people sometimes....

Good luck with everything... let's hope this guy has enough sense to not push the issue at all.

Not Rocky's fault, that guy should have known better than to be teasing the animals. Maybe Rocky taught him a lesson, you don't "play" with your pets like that. Sweet Rocky, protector of the house. Sorry Dora, what a cruddy way to start the new year. Keep us up to date if anything develops out of this. Hopefully that guy won't try to make anything of it, he shouldn't.

He's admitted it was his fault and you do have witnesses. Let him pay for his mistake. You may get a call from the hospital asking for your vets name so they can make sure that your dog has had all his shots.
