We have to give Lucky away!!!

We are going to talk to our friends who live about 5 minutes away and see if they were serious about taking him. Janaya (the wife) said yes last night, but she hasn't talked to her husband Dave about it. If they are willing to take him, that is probably going to be the solution we are going to have to live with. At least he will be close and we can go see him every day.

i trully hope that your friends will be able to keep your baby. it will be for 5 months only..... i know "only" is way too much for you, it is understandable. but i hope they will agree.it will be the best solution i think.

I went through the same kind of corporate crap with my old apartment complex. Luckily, they didn't go after my dogs at any point in all of the ridiculous things they pulled, or they would have been in a world of hurt!! I wonder if they are the same company!?!

You know, someone suggested going to the press about it and it got skirted over. I think that's a tremendous idea. It is NOT reasonable for them to make up a rule that you never agreed to and make people find arrangements for their animals in 3 days.

Roughly, how many other people were impacted by this? You should all get together and take action.

Sadly, verbal agreements are NOT binding in matters of real estate. Always, always, always get everything in writing when it concerns real estate. I'm sure there are still things you can do, though. Picket, petition???

Megan, I am so sorry that you have to go through this! I can only imagine what you are going through, I hate to be away from my baby for one night let alone 5 months. hey, this crossed my mind but i dont know how things work there so i didnt know what o suggest. but it certainly didnt sound normal to me this rule all of a sudden!!!
is there anything you can do about this???(the press or something....?)

This is good advice. Verbal contracts are legally binding in most states, but at the same time they are also officially termed "unenforcable" as they are impossible to prove, since they are not documented. I always wondered why bother warning people they are binding as obviously nobody can ever be held true to them? Makes no sense to me and just creates problems. Always document everything in writing to protect yourself!

Your apartment managers may be counting on everyone just to accept the new edict about dogs without challenging it. Personally, there is no WAY I'd just send my dog away. Let them take me to court - if they want to spend the money - and then they can explain to the judge how they announced new rules and gave everyone 72 hours to rehome their pets. It's crazy!! And just wrong. Seriously, I'd go to the local press and let them air it as a human interest story!

I don't think sub letting the apartment is a viable option, the apartment won't allow it

From my brokers classes (different state so this may not apply in Nebraska) I learned that in many cases, they cannot stop you from subletting. The proper term escapes me at the moment but you have a vested interest in the property while you are under an active lease and you may have the right to sublet under your state's laws, even if they tell you they forbid it. Many places will tell you they don't allow it as most people will not question it or dig into the law enough to discover that they can.

What if your lawyer wrote you a letter for a small fee ($50 or something), telling them they have to give you 90 days to find a new home for your dog, NOT three days. If they get something on a lawyer's letterhead they are almost certain to pay attention. You'd be a hero to others going through this if you could get them to give everyone 90 days.

Where do you live? I work for an attorney and I would be willing to check the law where you are, if you haven't already about the Lucky staying until the lease runs out. Although I am not an attorney, I have been in the field for many years and it seems to me that if you have a written lease with them indicating you can have a dog of Lucky's size, they can't break that lease mid way. They would have to at least give you written notice and 30 days I would think but again, I don't know what state you are in so if you want, let me know and I'll talk to an attorney and find out what the laws are where you live.

Okay, stupid me, just re-read your thread and saw you are in Nebraska. I'll check it out with my boss on Monday just to see what your rights are. I also think the subletting sounds good if it's allowed in your lease. Wish I lived close by, my husband and I would help in a hearbeat.

It would surely be a landmark case. There is PLENTY PLENTY PLENTY of evidence and studies and books authored by experts in both the animal sciences and human medical communities about the bond between people and their pets (particularly dogs). Dogs are used to relieve stress. People with dogs live longer lives. Dogs are used as therapy animals to help people in hospitals recover faster. The list goes on.

Separating you from your dog with only 72 hours notice is absolutely inflicting unnecessary trauma on you - both emotionally as well as physically, through the stress of separation and stress of ongoing worry for his well being.

Maybe your attorney will take the case on a contingency basis (only getting paid if you get a settlement) - some attorneys will consider this if the case can be groundbreaking / publishable.
